  1. The development hereby approved shall not be occupied unless and until space has been laid out within the site in accordance with the approved plans for vehicles to be parked and for vehicles to turn so that they may enter and leave the site in forward gear. Thereafter the parking/turning area shall be retained and maintained for its designated purpose.Reason: To ensure that the development does not prejudice highway safety nor cause inconvenience to other highway users, in accordance with Policy DM11 of the Surrey Heath Core Strategy and Development Management Policies 2012 and the National Planning Policy Framework.
  2. The development hereby permitted shall be begun within three years of the date of this permission.Reason: To prevent an accumulation of unimplemented planning permissions and in accordance with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51(1) of the Planning and Compulsory Purchase Act 2004.
  3. No development shall take place until details and samples of the external materials to be used shall be submitted to and approved in writing by the Local Planning Authority. Materials to be agreed will include the proposed brick, tile, guttering and fenestration. Once approved, the development shall be carried out using only the agreed materials.Reason: In the interests of visual amenities of the area and to accord with Policies CP2 and DM9 of the Surrey Heath Core Strategy and Development Management Policies 2012.
  4. The proposed development shall be built in accordance with the following approved plans: Amended Proposed Ground Floor Plan DR/E57EMRM/TJH/03P received 14.3.18, Proposed Elevations DR/E57EMRM/MH/04N received 30.1.18, Block Plan received 30.1.18.Reason: For the avoidance of doubt and in the interest of proper planning and as advised in ID.17a of the Planning Practice Guidance.
  5. No development shall commence until a Construction Transport Management Plan, to include details of:a) parking for vehicles of site personnel, operatives and visitorsb) loading and unloading of plant and materialsc) storage of plant and materialshas been submitted to and approved in writing by the Local Planning Authority. The approved details shall be implemented in full during the construction of the development.Reason: To ensure that the development does not prejudice highway safety nor cause inconvenience to other highway users, in accordance with Policy DM11 of the Surrey Heath Core Strategy and Development Management Policies 2012 and the National Planning Policy Framework.
  6. Notwithstanding Condition 3 above, prior to occupation of the development, provision for the secure parking of bicycles shall be provided within the site, in accordance with a scheme to be first submitted to and approved in writing by the Local Planning Authority. Thereafter the approved facilities shall be provided, retained in perpetuity and maintained to the satisfaction of the Local Planning Authority.Reason: To encourage sustainable methods of transport, in accordance with Policy CP11 of the Surrey Heath Core Strategy and Development Management Policies 2012 and the National Planning Policy Framework.
  7. The development hereby permitted shall not result in noise emanating from the site (other than that of cars accessing and egressing the site) outside the following hours:0800-1800 hours Monday to Friday 0800-1300 hours on SaturdaysThe above hours do not apply to Bank or Public Holidays.Reason: In order to safeguard the amenities of surrounding residential properties, in accordance with Policies CP2 and DM9 of the Surrey Heath Core Strategy and Development Management Policies 2012 and the National Planning Policy Framework.
  8. Prior to occupation of the development, full details of the proposed boundary treatments and proposed access gate shall be submitted to and approved in writing by the Local Planning Authority. The proposed details shall be implemented in full prior to the occupation of the development. Reason: In the interests of character, amenity and highway safety, in accordance with Policies CP2, DM9 and DM11 of the Surrey Heath Core Strategy and Development Management Policies Document 2012.
  9. Prior to commencement of the development hereby approved, full details of the noise from the proposed air conditioning units shall be submitted to and approved in writing by the Local Planning Authority. Reason: In order that the development does not cause significant adverse impacts on surrounding residential properties, and respects and enhances its local environment, in accordance with Policies CP2 and DM9 of the Surrey Heath Core Strategy and Development Management Policies 2012 and the National Planning Policy Framework.
  10. No external lighting shall be installed on the site without the full details of the lighting having first been submitted to and approved in writing by the Local Planning Authority. The details shall demonstrate that there shall be no light spillage over the boundary of the site and shall include the days and times that the lights will be in operation. No external lighting other than that approved by the above details shall be installed on site nor shall the lights be switched on outside of the approved times. Reason: To ensure that there is no significant adverse impacts on neighbours as a result of light pollution, in accordance with Policy DM9 of the Surrey Heath Core Strategy and Development Management Policies 2012 and the National Planning Policy Framework.
  11. The buildings hereby approved shall be used as Offices (Use Class B1) and Storage (Use Class B8) as set out in the Town and Country Planning (Use Classes Order) 1987 (as amended) (or any equivalent class in any Order revoking and replacing that Order) and for no other purpose without the prior approval in writing of the Local Planning Authority.Reason: For the avoidance of doubt and in order to safeguard the amenity of surrounding properties in accordance with Policy DM9 of the Surrey Heath Core Strategy and Development Management Policies 2012 and the National Planning Policy Framework.
Informative notes:
  1. The permission hereby granted shall not be construed as authority to obstruct the public highway by the erection of scaffolding, hoarding or any other device or apparatus for which a licence must be sought from the Highway Authority Local Highways Service
  2. The developer is reminded that it is an offence to allow materials to be carried from the site and deposited on or cause damage to the highway from uncleaned wheels or badly loaded vehicles. The Highway Authority will seek, wherever possible, to recover any expenses incurred in clearing, cleaning or repairing highway surfaces and prosecutes persistent offenders. (Highways Act 1980 Sections 131,148,149).
  3. In respect of Condition 6 above, the cycle parking should be designed and provided in accordance with the appropriate government guidance. This suggests that cycle parking should be lit, secure, adequately signed and as close to the destination as possible. B1 uses should provide 1 cycle space per 125m2 (minimum 2 spaces) and B8 uses 1 space per 500m2 (minimum 2 spaces). The details required under Condition 6 will be expected to comply with the above.
  4. The applicant's attention is drawn to the Party Walls (etc) Act 1996.
  5. The applicant is advised that this permission is only pursuant to the Town and Country Planning Act 1990 and is advised to contact Building Control with regard to the necessary consents applicable under the Building Regulations and the affects of legislation under the Building Act 1984.
  6. This decision notice is a legal document and therefore should be kept in a safe place as it may be required at a later date. A replacement copy can be obtained however there is a charge for this service.
